Update on Kasoa Mṹrder: I Wasn’t At The Mṹrder Scene – Main Suspect Defends himself
The second accused in the ongoing murder trial of 10-year-old Ishmael Mensah Abdullah has revealed that he was nowhere near the murder scene.
Nicholas Kani,15, has raised an Alibi defense, claiming that he has witnesses to back up his claim.
Kani is claiming that he was not at the scene of the crime at the time it occurred with this move.
This new twist was revealed in court on Wednesday, February 2, 2022, by Her Ladyship Justice Lydia Osei Marfo’s court.
She stated that Kani raised an Alibi defense, which was included in the Bill of Indictment.
As a result, the court has ordered him to file his notice of alibi for the prosecution to investigate within 21 days of today.
“The court has received the bill of indictment in this case, and according to the records, the second accused person (Nicholas Kani) has raised an Alibi defense,” Justice Osei Marfo continued.
Because of this, and in accordance with Section 131 subsection 3, the court stated, “despite the fact that the second accused person has not given notice and particulars of the said Alibi, I hereby order him and his counsel to file his notice of Alibi, after which the prosecution is to investigate this Alibi.”
The court also stated that “the prosecution is also ordered to serve the defense with their disclosures, which include the charge sheet, facts, witness statements, and statements accused persons have given at the police station.”
The court also stated that the prosecution should serve the accused with “anything of evidential value which they may or may not rely on at the trial.”
As a result, the case has been postponed until February 22, 2022.
Kani and a 15-year-old juvenile (name withheld) have been charged with Ishmael Mensah’s murder.
